Terms of Service – R.C. Brains

Welcome to “R.C. Brains”, a virtual reality multiplayer/social VR game developed and operated by AshRift Studios (“Company”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of R.C. Brains and any related websites, services, companion apps, and features (collectively, the “Services”).

By accessing or using R.C. Brains, you agree that you have read, understood, and accepted these Terms. If you do not agree, you must not use the Services.

For United States residents: Certain disputes must be resolved through binding individual arbitration, as described in Section 15.

1. Acceptance of Terms & Privacy Policy

By using R.C. Brains, you acknowledge and agree that:

3. If you do not agree to both documents, you must discontinue use of the Services.

2. Eligibility

You may only use R.C. Brains if you meet all of the following:

2.1 Age Requirements

• You must be at least 13 years old to use the Services.
  
  

• If you are between 13 and 17, your parent or legal guardian must review and accept these Terms and is responsible for your activity.

2.2 Parent-Managed Accounts (Ages 10–12)

Children 10–12 may play only through:

• A Meta Parent-Managed Account, and

• With parental approval for downloading the game.

2.3 Under 13 Without Parental Controls

If we discover that a child under 13 is using R.C. Brains without a Parent-Managed Account:

• Their account will be terminated, and

• All associated data will be deleted.

3. Meta Account Requirement

To play R.C. Brains, you must have a valid Meta account.

• The Company does not create Meta accounts.

• You are responsible for all activity performed using your Meta account.

• You must not share your account with others or allow children to use your account.

You may be held responsible for losses caused to the Company due to misuse of your account.

4. Limited License

Subject to your compliance with these Terms, we grant you a:

• Limited

• Non-exclusive

• Non-transferable

• Revocable

license to use R.C. Brains solely for personal, non-commercial use.

Any use outside these Terms is prohibited and may violate copyright or other laws.

5. Prohibited Uses

You agree NOT to:

5.1 Harm or Disrupt the Game

• Damage, disable, or degrade the Services

• Interfere with servers, networking, or performance

5.2 Violate Player Safety

• Harass, bully, threaten, intimidate, or engage in predatory behavior

• Engage in hate speech (racism, sexism, homophobia, transphobia, slurs)

• Share NSFW, offensive, violent, or harmful content

• Attempt to dox or reveal personal information

• Evade bans or exploit loopholes

5.3 Cheat or Exploit

• Use cheats, scripts, automation, bots

• Exploit bugs, glitches, or mechanics

• Promote mods, hacks, or unauthorized third-party tools

• Reverse engineer or attempt to access source code

5.4 Impersonation

Do not impersonate:

• Developers

• Moderators

• Streamers

• Public figures

• Other players

5.5 Scams & Deception

You may not:

• Promote scams

• Attempt to manipulate or socially engineer players

• Engage in fraudulent or deceptive behaviors

5.6 Personal Information

You may not share your own or another person’s personal information in-game.

6. Player Moderation & Voice Monitoring

6.1 Voice Monitoring for Safety

R.C. Brains uses manual and automated moderation tools, including:

• Real-time voice monitoring

• Temporary audio capture

• Automated behavior detection systems

• Player reporting mechanisms

Voice data may be recorded only for moderation, encrypted, and shared only with an approved safety vendor (e.g., VoicePatrol).

Retention period is minimal and temporary, as described in our Privacy Policy.

6.2 Moderation Authority

Moderators and the Company may:

• Mute, restrict, suspend, or permanently ban any player

• Act at their discretion even if the behavior is not explicitly listed in this ToS

6.3 Appeals

7. Beta Testing Disclaimer

R.C. Brains may include experimental, beta, or pre-release features.

• The game is provided “as is” and “as available.”

• Features may change, break, or be removed at any time.

• We may revoke your access to testing programs without notice.

8. Virtual Currency & Digital Items

R.C. Brains may include virtual currencies or items such as:

• Skins

• Cosmetic

• RC car parts

• Power-ups

• Tokens

8.1 License, Not Ownership

You do not own virtual items. You receive a limited license to use them.

8.2 No Refunds

All purchases are final, non-refundable, and have no cash value.

8.3 No Transfers

Virtual items:

• Cannot be transferred

• Cannot be traded

• Cannot be sold

8.4 Account Termination

If your account is banned, you lose all virtual items.
No compensation is provided.

9. User-Generated Content (UGC)

UGC includes:

• Creations

• Voice chat

• Images

• Builds

• Animations

• Videos

• Names

• In-game assets

9.1 Rights You Grant Us

By creating UGC, you grant the Company:

• An irrevocable, perpetual, worldwide, royalty-free license

• To use, modify, host, reproduce, distribute, create derivative works, and display your UGC in any media

9.2 Your Responsibility

You warrant that:

• You own or have rights to the UGC

• It does not infringe any third-party rights

• It complies with the ToS

9.3 Removal

We may remove or disable UGC at any time, for any reason.

10. Health & Safety

VR may cause:

• Motion sickness

• Eye strain

• Loss of balance

• Seizures

• Nausea

• Disorientation

You agree to:

• Follow Meta’s VR Health & Safety Guidelines

• Play in a safe indoor environment

• Take breaks every 10–15 minutes

• Remove the headset immediately if you feel unwell

The Company is not responsible for VR-related injuries or property damage.

11. Intellectual Property

All proprietary rights in R.C. Brains belong to AshRift Studios

You may not:

• Copy

• Modify

• Distribute

• Reverse engineer

• Create derivative works

Without express written permission.

12. Disclaimers

R.C. Brains is provided “AS IS” without warranties of any kind.

We do not guarantee:

• Error-free gameplay

• Continuous operation

• Compatibility with all devices

• Protection from malicious players

Use of R.C. Brains is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless AshRift Studios from any claims, damages, losses, or expenses arising from:

• Your use of the Services

• Your UGC

• Your violation of these Terms

• Your illegal or harmful behavior

14. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, punitive, or consequential damages.

• Our total liability is limited to the amount you paid for R.C. Brains (if any).

15. Binding Arbitration (U.S. Residents)

This section applies to U.S. users only.

• Disputes must be resolved through individual binding arbitration in Los Angeles, California.

• No class actions or group litigation are allowed.

Non-U.S. users may pursue claims according to their local jurisdiction.

16. Termination

We may suspend or terminate your access to R.C. Brains at any time, for any reason, including:

• Safety concerns

• Repeated misconduct

• Violation of these Terms

• Abusive behavior

• Attempts to exploit the game

Upon termination:

• Your license ends

• Your virtual items, progress, and account data may be deleted

17. Changes to the Terms

We may update these Terms at any time.
Updates become effective when published at: https://www.rcbrains.com/

Continued use of R.C. Brains means you accept the updated Terms.
